A Missouri man received four separate seven-year prison sentences for his involvement in a traffic accident that killed his 3-year-old son and injured four other people. According to the Missouri State Highway Patrol crash report, the man’s eastbound Toyota crossed the center line and collided with a westbound 2005 Ford Explorer. A Chevrolet Impala struck the Explorer after the initial collision. In addition to his son’s death, four people involved in the crash were injured.
According to Missouri State Highway Patrol, the man was observed after the accident “…stumbling around and had the strong odor of an intoxicating beverage emitting from him …His speech was slurred and he spoke slow.”
The man refused a breath test so The Highway Patrol seized a blood sample under exigent circumstances, meaning troopers had no warrant with which to search him or obtain his blood. The sample taken approximately 2 hours after the crash showed him having a blood alcohol content of .067, however a blood sample taken by the hospital 33 minutes after the crash showed him with a blood alcohol content of .102 which is higher than the legal limit of .08 in Missouri.
